Presumptuous Justice

Presumption of innocence is an important part of our standard of justice. It is a term you have heard plenty of times in the past. The idea on the face of it is quite simple. If you or anyone else is accused of a crime, you are “presumed innocent until proven guilty”. That phrase was coined by William Garrow more than a century ago.[1] The idea however dates back as far as sixth century in Roman law from Digest of Justinian which states Ei incumbit probatio qui dicit, non qui negat – “Proof lies on him who asserts, not on him who denies.

False Compassion

There is no shortage of problems to solve, and even more ideas on how to solve them. One thing that goes quickly forgotten when discussing solutions is when the rubber meets the road. To which I mean the financial and practical implications of such a solution. While we should not let these factors bar us from brainstorming solutions, we need to make sure that we do not employ false compassion.

It was just one of those days while staying in a hotel where I was casually watching C-SPAN – as I know all of us do regularly – when I heard one of the senators mention that we should not act with false compassion. This idea was something I have often thought of and gives it a concise and memorable phrase that I am now running with. Specific Groups Need Not Apply

Life isn’t fair. It is a phrase that we are told all the time but it does not make it any easier for us to internalize. We all wish the world was more fair. Discrimination is one of the areas of life that makes life feel unfair. I recently saw an article about an Asian man who wanted to sue a gay dating app called Grindr because of the number of profiles who mention they were not interested in Asians. He claimed that the app is “breeding ground that perpetuates racism against gay Asian [men].” I have heard of the stigma of being a gay Asian man before, and it is definitely not something to celebrate about the gay community. This article got me thinking about how he wanted to deal with this discrimination. So I decided to go through what I see are the most common ways we can all deal with discrimination.
